However, Third Party did not turn up. Meanwhile, appellant has filed his FA dated 07.05.2014, before Learned FAA, who vide his order dated 22.01.2015, disposed of the FA by upholding the views of CPIO, without application of his mind, as to whether the required information has since been provided to the appellant or not.

However, on careful perusal of the case-file, there appears that in the absence of consent from the Third Party, the CPIO should considered the matter in the larger public interest, as to whether the required information is to be provided to the appellant or not. Not only this, Learned FAA also ignored this aspect while disposing of the appellant's FA and simply upheld the CPIO's response dated 03.04.2014, vide which CPIO has denied the required information in a technical ground only.
