Appellant through his RTI application sought information with respect to Water pipeline constructed by Delhi Jal board for which fund of Rs 71.93 lakhs provided by the government, where the pipeline drawn etc. Having received no reply from the PIO within prescribed time, the appellant made First Appeal. Claiming non furnishing of information from the respondent authority, appellant approach the Commission through this present second appeal.
Proceedings Before the Commission:
2. The appellant is not present. The Public Authority made their submissions. They submitted that the appellant is seeking information about the pipeline laid in the blocks CIC/SA/A/2014/001654 Page 1 15 and 18 of Dakshin Puri Extension, where the water pressure is very low, because these blocks are at the farthest distance from the reservoir. They also submitted that the water supply is made on alternate days for these two blocks separately. The Commission observes that the respondent authority has written to the appellant that the appellant should take prior permission for availing the inspection of record. This kind of reply amounts to denial of information to the appellant. If the information sought by the appellant is available in the records, it is the duty of the PIO to furnish the same or offer inspection of the same. It is not legal on the part of the PIO to insist on prior approval. The Commission, therefore, directs the respondent authority to facilitate inspection to the appellant within 10 days from the date of receipt of this order. The appeal is disposed of.
