Mr.Kailash Chand Guptaq vs Planning Commission on 21 May, 2013

The Commission has received an appeal dated 22.1.2013 from Mr. Kailash Chand Gupta against the Planning Commission stating that the first-appellate authority has not decided his first-appeal dated 25.9.2012 pertaining to his RTI- request dated 28.7.2012.

2. Perused the documents submitted by the Appellant. It is observed that Appellant's RTI-request dated 28.7.2012 was replied to by CPIO, Unique Identification Authority of India, New Delhi vide letter dated 30.10.2012.

3. The Appellant filed his first-appeal on 25.9.2012 before AA, Unique Identification Authority of India, New Delhi which was not decided by AA.

4. In order to avoid multiple proceedings under section 19 and 18 of the RTI Act, viz., appeals and complaints, the matter is remitted to Dy. Director General, Unique Identification Authority of India, New Delhi (along with a copy of complaint), with the following directions:
